Asbestos Testing in New York City

Asbestos Testing in New York City

If you’re planning a home renovation, construction, demolition, or maintenance project in New York, don’t take risks when it comes to potential exposure to hazardous materials.

Asbestos testing requires skilled, licensed professionals, and all building permits in New York City require an asbestos inspection and testing service, also known as an ACP-5. This is especially important for New York’s older buildings.

Many buildings contain asbestos, which can cause issues if you need to do construction or renovation work. When Asbestos Containing Materials (ACMs) are disturbed, especially friable materials like insulation, they release microscopic asbestos fibres which pose a serious risk to human health when inhaled.

Whether you have an older residential home, rental, or commercial business, get a professional asbestos inspection in New York from the certified and experienced team at AAA.

When to Get an Asbestos Inspection

Properties built in the U.S. before the 1980s have an increased likelihood of containing asbestos.

Before performing any kind of renovation or demolition work, you’ll need to ensure the project will not disturb any Asbestos Containing Materials (ACMs). In New York City, this is known as an ACP-5 inspection.

If the work area is found to contain hazardous asbestos, property owners are required by law to have it safely and professionally abated or removed in order to proceed with renovations.

When selling or leasing, an asbestos report can make a property more appealing to buyers or lessees.

What is a New York ACP-5 report for asbestos?

An ACP-5 form is an asbestos assessment report required by the NY Department of Buildings (DOB), stating that the work area has been declared asbestos-free by a Department of Environmental Protection (DEP) certified asbestos investigator. The form is also used if the project has asbestos that won’t be disturbed, or is minimal enough to be considered a minor project.

When do I need an ACP-7 asbestos form in New York City?

An ACP-7 form is an Asbestos Project Notification form that is filed with the City of New York. It is required whenever you are conducting a project that will involve asbestos-related work, or if the project may disturb or come into contact with ACMs.

It must be filed at least one week in advance and is valid for one year. Any form of work that “will disturb more than 25 linear feet or more than 10 square feet of asbestos-containing material” needs an ACP-7, according to New York’s Department of Environmental Protection (DEP).

Who can perform asbestos testing in New York?

You can’t hire just anybody as an asbestos inspector, nor should you attempt to do it yourself. You need NY-licensed asbestos professionals like us.

In New York, it is against the law to hire untrained employees or firms for work on Asbestos Containing Materials (ACMs), including:

  • Inspections and tests
  • Management plans
  • Removal and abatement
  • General contracting (renovations, etc.) that disturbs asbestos

The Environmental Protection Agency (EPA), OSHA, and New York State all have requirements for the certification, training, and licensing of companies and individuals for asbestos projects.

These regulations ensure both your safety and that of the workers.

Is asbestos illegal in New York?

Yes. New York has banned the sale and distribution of asbestos. There is currently no complete federal asbestos ban, although its use and handling are now subject to tight regulations.

It’s not illegal to have old Asbestos Containing Material (ACM) in your property, but it does pose a health risk, particularly if the material is friable or already damaged.

However, if you plan to renovate or do other work that could disturb ACMs, you must first check whether those materials contain asbestos.
